1. Acceptance of Terms
By accessing or using RoostR ("the Platform"), you agree to be bound by these Terms of Service. If you do not agree, you may not use the Platform.
2. Platform Description
RoostR is a peer-to-peer marketplace that connects motorcycle owners ("Hosts") with riders ("Riders") and local guides ("Guides"). RoostR does not own, operate, insure, or manage any motorcycle rentals or guided experiences listed on the Platform. All transactions and arrangements are made directly between members.
3. Eligibility
You must be at least 18 years old and legally permitted to operate a motorcycle in your jurisdiction to use certain features of the Platform. By creating an account, you represent that you meet these requirements.
4. Host Responsibilities
Hosts are solely responsible for their motorcycle listings, including accuracy of information, maintenance, legal registration, and any insurance coverage. Hosts must comply with all applicable local laws regarding vehicle rentals. RoostR is not liable for any damages, injuries, or losses arising from a rental transaction.
5. Rider Responsibilities
Riders are responsible for having a valid motorcycle license appropriate for the vehicle rented, operating rented vehicles safely and legally, returning vehicles in the same condition as received, and any damages caused during the rental period.
6. Guide Responsibilities
Guides are independently responsible for all aspects of their guided experiences, including rider safety, liability waivers, appropriate insurance, legal compliance, land access permits, and any agreements made with riders. RoostR does not endorse or operate any guided rides listed on the Platform.
7. Memberships & Payments
Access to certain features requires a paid membership (Rider, Host, or Guide). Memberships are billed on the cycle described at purchase. You may cancel at any time; however, RoostR does not offer refunds for partial billing periods unless required by law. All payments are processed securely through Stripe.
8. Prohibited Conduct
You agree not to: use the Platform for any unlawful purpose; post false or misleading information; harass or harm other users; attempt to gain unauthorized access to the Platform; or use the Platform to compete with RoostR.
9. Limitation of Liability
To the fullest extent permitted by law, RoostR and its affiliates shall not be liable for any indirect, incidental, special, or consequential damages arising out of your use of the Platform, including but not limited to personal injury, property damage, or financial loss resulting from rental transactions or guided experiences.
10. Indemnification
You agree to indemnify and hold harmless RoostR, its officers, directors, employees, and agents from any claims, damages, or expenses arising out of your use of the Platform, your violation of these Terms, or your interactions with other members.
11. Intellectual Property
All content on the Platform, including logos, design, and software, is owned by or licensed to RoostR. You may not reproduce, distribute, or create derivative works without our express written permission.
12. Termination
RoostR reserves the right to suspend or terminate your account at any time for violations of these Terms or for any other reason at our sole discretion.
13. Changes to Terms
We may update these Terms at any time. Continued use of the Platform after changes constitutes acceptance of the revised Terms. We will notify users of material changes where possible.
14. Governing Law
These Terms are governed by the laws of the State of Utah, United States, without regard to conflict of law principles.
